Meaning of "You";"We/Us/Our"
a. "You" means any member of the public using this website, placing an order or transacting on this website.
b. "We/Us/Our" means Memwah Limited.
Your contract for purchases made through the Site is with Memwah.com, and you undertake that any and all goods ordered by you are for your own private and domestic use only.
You must be eighteen years old to use this site. If you are under eighteen, you may only use the site in conjunction with, and under the supervision of, a parent or guardian. If you do not qualify, please do not use the site.
While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, we will purchase the items from you to the amount you originally paid for.
No contract for the sale of any product will subsist between you and Memwah.com until Memwah.com dispatches the product(s) ordered. We will confirm that the product(s) have been dispatched by a confirmation email. This confirmation e-mail amounts to an acceptance by Memwah.com of your offer to buy goods from Memwah.com.
When you place an order on our website to purchase goods from us that constitutes an "Offer to Buy" from you, We accept this order when we send you an 'Order Confirmation" (or "Shipment") email confirming that we have dispatched the goods you have ordered form us. This acceptance will be deemed to be complete and communicated to you at the time we send the Confirmation (or Shipment) email, whether you receive the email or not.
You agree that e-mail can be used as a long-distance means of communication.
This confirmatory e-mail will contain all relevant statutory information concerning your contract.
The confirmatory e-mail will also contain a link to these terms and conditions, and may be amended in accordance with paragraph 43 below from time to time.
You must check that the details on this confirmatory e-mail are correct as soon as possible and you should print out and keep a copy of it.
Memwah will not pass on your personal or credit or debit card details to any third party except where an additional security check may be deemed necessary. We shall be entitled to process your data in accordance with the terms of our Privacy Policy. Please view this document for further information.
You undertake that all details you provide to Memwah for the purpose of ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered.
You must choose a username and password on completion of registration. You are responsible for all actions taken under that username and password and shall only use the Site under your own username and password. You must make every effort to keep your password safe and should not disclose it to anyone. If it is compromised, you must change it. You may not transfer or sell your username to anyone, nor permit, either directly or indirectly, anyone to use your username or password.
If there are any changes to the details supplied by you it is your responsibility to inform Memwah as soon as possible.
All sales made by Memwah to you are outright and unconditional and are non-exchangeable, non-refundable and non-transferable except at Memwah's discretion.
You may cancel your order at any time prior to your order being processed. We can accept cancellations by submission of a cancellation request ticket to our support centre. You may also withdraw from the contract at any time after the product has been dispatched and you have received our email confirming your order but no later than 14 working days after the day after you receive the product by:
1. Sending the notice of cancellation by ticket to Memwah ensuring that you quote your name, address and order reference number; or
2. Where you have already received the goods, returning the goods to Memwah unopened together with the original invoice. Memwah will purchase the goods from you at the original price of the goods.
Once Memwah receive notification from you that you wish to withdraw from the contract (in accordance with these terms), any sum debited to Memwah from your credit card in relation to your order will be re-credited to that credit card account as soon as possible and in any event within 30 days of your order provided that the goods you wish to return are received by Memwah in the condition that they were in when delivered to you. You will be liable for any charges incurred in returning the goods to Memwah.
Memwah reserves the right to make a 10% restocking charge for any goods which are not returned in mint condition or to refuse to accept such goods, at its sole discretion. Memwah also reserves the right to make a charge for collecting goods from your premises in circumstances where they are not defective but you have cancelled your order. Your statutory rights are not affected.
Registered users are permitted to post reviews on products provided that they comply with our Customer Review Guidelines.
You acknowledge that any review, feedback or rating which you leave may be published and agree that it may be displayed for as long as we consider appropriate and that the content may be syndicated to other Memwah sites and publications.
You agree to indemnify and hold us harmless against any claim or action brought by third parties, arising out of or in connection with any feedback, ratings or reviews posted by you on the website, including the violation of their privacy or intellectual property rights.
You grant Memwah and its affiliate companies a non-exclusive, royalty-free worldwide license to use or edit any reviews posted by you. We reserve the right to publish, edit or remove any reviews without notifying you.
Competition T&Cs
By entering a competition entrants accept these terms and conditions together with any specific instructions and terms for such competition which may be mentioned in any electronic messages, or on the website, or communicated to entrants in any other way (“competition information”). Such competition information shall prevail in the event of there being any inconsistency between these competition terms and conditions and any competition information.
Memwah Limited may cancel or amend any competition, competition information, or these terms and conditions without prior notice. Any changes will be posted either within the competition information or these terms and conditions.
The competition is open to all residents of the United Kingdom. There is no minimum age limit unless specified otherwise in the competition information.
The opening and closing dates and times for entries are as indicated in the competition information. Any entries received before the opening and after the closing of the competition will be invalid and will not be entered into the competition.
Where specified in the competition information as an available method of entry to the competition, web entrants are required to follow the instructions on the website as indicated in the competition information. Entrants will receive a message confirming entry to the competition. Web entrants may be required to supply their name, and/or email address and/or a contact telephone number and/or any other details. In the event that entrants are required to pay to enter online, entrants will need to use the relevant payment service indicated in the competition information, and may need to open an account and register to pay for online entry to the competition. Online entry costs will be as indicated in the competition information. Entrants must read and accept the terms and conditions relating to the online entry pay service before proceeding with such a web entry.
Entries submitted through agents or third parties or in bulk (i.e. more entries than a human being could submit in the time available without the use of software or other devices designed to make automated entries or, in the case of postal entries, more than one entry submitted under the same postage stamp) will not be accepted. Entrants may enter as many times as they like unless otherwise indicated in the competition information but no more than one prize per person per competition will be awarded.
The process for determining the winner of the prize is as indicated in the competition information. Where the winner is randomly selected from all correct and valid entries, the draw for the winner will take place within 7 days of the date on which the competition closes.
Prize draw prizes will be awarded in accordance with the laws of chance and, if required by law or regulation, under the supervision of an independent observer. Any competition requiring a subjective assessment in the selection of winning entries will be judged by Memwah or as indicated in the competition information and, if required by law or regulation, an independent judge or a panel including one member who is independent of the competition's promoters and intermediaries.
Should more prizes be claimed than are available for any reason, a simple prize draw will take place for the available prize(s).
Memwah will attempt to notify the winner for up to 28 days after the closing date and time for entries to the competition, or as otherwise indicated in the competition information. He/she will be contacted on the phone number, e-mail, or postal address provided when entering the competition. The winner will have a specified fixed time period in which to claim his or her prize. If Memwah is unable to notify the winner, or if the winner fails to respond within the fixed time period as specified and/or provide an address for delivery of the prize, this may result in forfeiture of the prize and Memwah reserves the right to select an alternative winner in accordance with these terms and conditions and the competition information.
