Stock Availability

In the event that any of the products ordered is not in stock, we will contact you in within 15 days of your order date to inform you of restock dates.

If there are certain products that become temporarily unavailable, we will send the available products.

Items not yet available:

If you have ordered an item prior to its release date, we will hold your order and dispatch the item to you as soon as stock is available. Your card is not charged until the order is processed.

Satisfaction, or your money back

When you purchase a product from us, the goods are sold outright by us and belong to you. However, if you are not satisfied with the product we will purchase the product back subject to the criteria below being met.

Memwah allows you 21 calendar days to return a product that you are not satisfied with without prejudicing the fact that our sale to you is outright and is not a sale on approval. You can return the product within this time period, at your own expense, accompanied by your invoice. You must obtain an RMA number issued on submission of a support ticket.

We request that you send us the merchandise by registered post and that you purchase insurance with the carrier for the value of the merchandise. Shipping fees remain the customer's responsibility. We are not responsible for any items lost in this way.

The right of return only applies to products that are returned in their original, complete working condition (packaging, accessories, user guide etc.). Any product that has been damaged, or is not in its original packaging, or has packaging that has been worn beyond simply opening the product, will not be repurchased from you by us.

All photos stored on a digital support (memory card, hard drive etc.) and sent back to Memwah by the User will not be preserved. The deadlines mentioned above are effective as of the date of receipt of the order. You can fill in your returns details in your MY ACCOUNT area on the site.

For reimbursements:

If the product purchased by us is returned within 21 working days of its delivery, the User will be paid by Loyalty Points, bank transfer if payment was made by bank card, or by cheque in other cases.

If tests need to be carried out on the product, in the framework of the right of retraction, Memwah will do its best to pay the User as quickly as possible. This time period will depend on the nature of the technical tests performed by the After-Sales Service of your products manufacturer, for a maximum period of 3 weeks.

If the product is returned between the 22nd and 30th working day after purchase, you will be paid in the form of Loyalty points.

Defective items:

If you have received a damaged or defective item(s) you wish to return, please contact us by opening a new support ticket located in "My Account". Select the category "Regarding a Recent Order" and select the order number associated with the defective item.

An RMA (Return Merchandise Authorization) number will then be generated within the newly open ticket.

Damaged or defective items must be returned to us securely packaged.

If the returned items are faulty as described in your ticket, we will choose the method of dispatch.

Replacements can take anywhere up to 3 weeks after receiving the items to process.

If there were multiple items in your order, please only send the items you wish to be replaced.

We recommend that you send your damaged or defective items via a reliable carrier as we do not take responsibility for lost returns.

Reimbursement for cost of shipping an item to us will be provided in the form of Memwah Loyalty Points credited into your account.

We reserve the right to reimburse returned shipping only up to the cost of standard tracked delivery.

The cost of items sent back via private couriers such as DHL and UPS will not be reimbursed fully.

Meaning of "You";"We/Us/Our"

a. "You" means any member of the public using this website, placing an order or transacting on this website.

b. "We/Us/Our" means Memwah Limited.

Your contract for purchases made through the Site is with Memwah.com, and you undertake that any and all goods ordered by you are for your own private and domestic use only.

You must be eighteen years old to use this site. If you are under eighteen, you may only use the site in conjunction with, and under the supervision of, a parent or guardian. If you do not qualify, please do not use the site.

While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, we will purchase the items from you to the amount you originally paid for.

No contract for the sale of any product will subsist between you and Memwah.com until Memwah.com dispatches the product(s) ordered. We will confirm that the product(s) have been dispatched by a confirmation email. This confirmation e-mail amounts to an acceptance by Memwah.com of your offer to buy goods from Memwah.com.

When you place an order on our website to purchase goods from us that constitutes an "Offer to Buy" from you, We accept this order when we send you an 'Order Confirmation" (or "Shipment") email confirming that we have dispatched the goods you have ordered form us. This acceptance will be deemed to be complete and communicated to you at the time we send the Confirmation (or Shipment) email, whether you receive the email or not.

You agree that e-mail can be used as a long-distance means of communication.

This confirmatory e-mail will contain all relevant statutory information concerning your contract.

The confirmatory e-mail will also contain a link to these terms and conditions, and may be amended in accordance with paragraph 43 below from time to time.

You must check that the details on this confirmatory e-mail are correct as soon as possible and you should print out and keep a copy of it.

Memwah will not pass on your personal or credit or debit card details to any third party except where an additional security check may be deemed necessary. We shall be entitled to process your data in accordance with the terms of our Privacy Policy. Please view this document for further information.

You undertake that all details you provide to Memwah for the purpose of ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered.

You must choose a username and password on completion of registration. You are responsible for all actions taken under that username and password and shall only use the Site under your own username and password. You must make every effort to keep your password safe and should not disclose it to anyone. If it is compromised, you must change it. You may not transfer or sell your username to anyone, nor permit, either directly or indirectly, anyone to use your username or password.

If there are any changes to the details supplied by you it is your responsibility to inform Memwah as soon as possible.

All sales made by Memwah to you are outright and unconditional and are non-exchangeable, non-refundable and non-transferable except at Memwah's discretion.

You may cancel your order at any time prior to your order being processed. We can accept cancellations by submission of a cancellation request ticket to our support centre. You may also withdraw from the contract at any time after the product has been dispatched and you have received our email confirming your order but no later than 14 working days after the day after you receive the product by:

1. Sending the notice of cancellation by ticket to Memwah ensuring that you quote your name, address and order reference number; or

2. Where you have already received the goods, returning the goods to Memwah unopened together with the original invoice. Memwah will purchase the goods from you at the original price of the goods.

Once Memwah receive notification from you that you wish to withdraw from the contract (in accordance with these terms), any sum debited to Memwah from your credit card in relation to your order will be re-credited to that credit card account as soon as possible and in any event within 30 days of your order provided that the goods you wish to return are received by Memwah in the condition that they were in when delivered to you. You will be liable for any charges incurred in returning the goods to Memwah.

Memwah reserves the right to make a 10% restocking charge for any goods which are not returned in mint condition or to refuse to accept such goods, at its sole discretion. Memwah also reserves the right to make a charge for collecting goods from your premises in circumstances where they are not defective but you have cancelled your order. Your statutory rights are not affected.

Registered users are permitted to post reviews on products provided that they comply with our Customer Review Guidelines.

You acknowledge that any review, feedback or rating which you leave may be published and agree that it may be displayed for as long as we consider appropriate and that the content may be syndicated to other Memwah sites and publications.

You agree to indemnify and hold us harmless against any claim or action brought by third parties, arising out of or in connection with any feedback, ratings or reviews posted by you on the website, including the violation of their privacy or intellectual property rights.

You grant Memwah and its affiliate companies a non-exclusive, royalty-free worldwide license to use or edit any reviews posted by you. We reserve the right to publish, edit or remove any reviews without notifying you.

Competition T&Cs

By entering a competition entrants accept these terms and conditions together with any specific instructions and terms for such competition which may be mentioned in any electronic messages, or on the website, or communicated to entrants in any other way (“competition information”). Such competition information shall prevail in the event of there being any inconsistency between these competition terms and conditions and any competition information.

Memwah Limited may cancel or amend any competition, competition information, or these terms and conditions without prior notice. Any changes will be posted either within the competition information or these terms and conditions.

The competition is open to all residents of the United Kingdom. There is no minimum age limit unless specified otherwise in the competition information.

The opening and closing dates and times for entries are as indicated in the competition information. Any entries received before the opening and after the closing of the competition will be invalid and will not be entered into the competition.

Where specified in the competition information as an available method of entry to the competition, web entrants are required to follow the instructions on the website as indicated in the competition information. Entrants will receive a message confirming entry to the competition. Web entrants may be required to supply their name, and/or email address and/or a contact telephone number and/or any other details. In the event that entrants are required to pay to enter online, entrants will need to use the relevant payment service indicated in the competition information, and may need to open an account and register to pay for online entry to the competition. Online entry costs will be as indicated in the competition information. Entrants must read and accept the terms and conditions relating to the online entry pay service before proceeding with such a web entry.

Entries submitted through agents or third parties or in bulk (i.e. more entries than a human being could submit in the time available without the use of software or other devices designed to make automated entries or, in the case of postal entries, more than one entry submitted under the same postage stamp) will not be accepted. Entrants may enter as many times as they like unless otherwise indicated in the competition information but no more than one prize per person per competition will be awarded.

The process for determining the winner of the prize is as indicated in the competition information. Where the winner is randomly selected from all correct and valid entries, the draw for the winner will take place within 7 days of the date on which the competition closes.

Prize draw prizes will be awarded in accordance with the laws of chance and, if required by law or regulation, under the supervision of an independent observer. Any competition requiring a subjective assessment in the selection of winning entries will be judged by Memwah or as indicated in the competition information and, if required by law or regulation, an independent judge or a panel including one member who is independent of the competition's promoters and intermediaries.

Should more prizes be claimed than are available for any reason, a simple prize draw will take place for the available prize(s).

Memwah will attempt to notify the winner for up to 28 days after the closing date and time for entries to the competition, or as otherwise indicated in the competition information. He/she will be contacted on the phone number, e-mail, or postal address provided when entering the competition. The winner will have a specified fixed time period in which to claim his or her prize. If Memwah is unable to notify the winner, or if the winner fails to respond within the fixed time period as specified and/or provide an address for delivery of the prize, this may result in forfeiture of the prize and Memwah reserves the right to select an alternative winner in accordance with these terms and conditions and the competition information.

What do the class numbers on memory cards mean?

As you may have noticed, there's another number printed on a memory card other than the capacity size.

These are the Speed Class Ratings!

The Speed Class Rating of a memory card is based on the minimum write speed on a blank memory card.

Memory cards have three performance classes, Class 2, Class 4 and Class 6.
The higher the number, the higher the class and the speed of the memory card.

Having a high class memory card is essential when having to deal with high resolution pictures, movie and other large data files as accessing large files on a lower speed memory card takes considerably longer to load.

Memwah.com will never ask for your credit/debit card four-digit security PIN under any circumstances. If you are contacted or receive an unsolicited email which asks you for your password or personal banking information, disregard the request and report the communication to Memwah for investigation.

The information collected by Memwah when you register with us at the www.Memwah.com website is generally used to communicate with you and improve our services where possible, and specifically, to process payments or enable third parties to carry out technical or commercial supporting functions. These functions may be carried out by us or appointed third parties who are bound by Data Protection covenants and must process the personal information in accordance with this Privacy Policy and the Data Protection Laws of the United Kingdom.

In addition to personal data such as name, e-mail address, delivery address, billing address, credit or debit card number and expiry date, we may also analyse data about participants in order to provide a safe shopping environment for all users. Shipping

Standard Delivery (Currently FREE!)

Delivery times are calculated in working days - i.e. Monday to Friday inclusive. If you order after 1pm, please calculate your delivery time as if your order had been placed the following working day.

Royal Mail - First Class: - 1 - 3 Working Days (FREE Delivery!)

Recorded Delivery : UK

Choosing our Recorded service will require that your package is signed for at your chosen delivery address. Royal Mail estimates that packages sent via this method take 2 - 4 days. You will also be able to track your package with the online tracking number provided to you via email on despatch.

We will do our best to meet the mentioned delivery times. Unfortunately, they may be affected by factors beyond our control and as a result, we cannot guarantee them. We will inform you if we are made aware of any unexpected delays.

In the event your item is lost in the post, please allow 15 working days from the date of dispatch before making a claim, as this allows us sufficient time to undertake our track and trace procedure.

My order has not yet arrived

Delivery usually takes around 3 - 4 days after your order status has been updated to 'Shipped'. If, after 21 days you still have not received your items, please open a support ticket from your MY ACCOUNT area and choose the order number that you have yet to receive and select 'My order did not arrive'. A member of our support department will then deal with you as soon as possible.

We suggest reporting missing items before 30 days have elapsed from the date of dispatch to allow us to locate your missing order efficiently.

Missing items from my order:

If your order consists of multiple items, they may not be shipped as one package. Your invoice slip as well as your orders information page will confirm this.

Delivery FAQ

Your order will be delivered to the address you indicated when you placed your order. While we strive for same day dispatch, this will usually only apply to orders placed before 1:00pm GMT.

You can view the status of your orders in your MY ACCOUNT area. Click on the order number for which you wish to specifically see details. These details include date of purchase, date of packing and date of dispatch, billing and shipping address.

Delivery Address:

As all our packages use the delivery address printed directly from the customers shipping details, we are not able to take responsibility for any parcels being undelivered due to incorrectly provided information.

Please make sure that the address you provide is correct and complete. Simple mistakes like forgetting to add the house number is quite common.

If by chance a parcel is dispatched to an incorrectly provided or incomplete address, the postal service will most likely return the parcel back to the sender.

You may be charged for the cost of subsequent redispatch to the correct address.

The cost of shipping will not be refunded if parcel is returned to us and items are no longer wanted. A 10% restocking fee on the cost of the whole order may be charged in these circumstances.

Attempted delivery:

Any failed deliveries due to the customer not being present will also usually be sent back to us after repeated failures by the customer to collect from a depot - you should however receive a card to notify you of delivery failures.

We are not able to take responsibility for the customer not being able to receive their goods under these circumstances.

Once the goods are paid for, these constitute your goods and in accordance with your instructions, we will arrange delivery of the goods.

Unless you notify us, in respect of all orders at the time of placing the order, that you will arrange for your own collection of goods from our place of business in Jersey, we will arrange the dispatch of your order on your behalf.

Customs duty and VAT

The Prices payable for goods as set out in the web site are, inclusive of VAT and shipping/handling costs. We do not charge for deliveries to the UK.

Consignments imported by individuals to the UK of a value of £17.99 or under are relieved from import VAT and duties under legislation.

For goods priced at £18 and above imported by you into the UK, we will, unless you inform us otherwise, arrange for VAT at 15% and any applicable Customs duty due on your importation to be paid to HM Revenue and Customs. This procedure is for your convenience only and is specific for the importations you make into the UK. This arrangement does not change any of the relevant terms and conditions mention in this document. For the avoidance of doubt, you are and will remain the importer of all goods ordered by you and shipped to an address outside the Channel Islands and will at all times remain liable for any import VAT, Customs or other duty chargeable thereon. For purchases by UK businesses, no evidence of payment of UK import VAT can be provided.

We will, unless you inform us otherwise, arrange for VAT at 15% to be paid to HM revenue and customs.

Non-UK deliveries

If you are ordering goods for delivery outside of the UK, please note that your consignment may be subject to import VAT, duties and taxes, which are levied once the goods reach the country of destination. Any such charges levied in relation to customs clearance must be borne to you. It is accepted by you that Memwah has no control over additional charges in customs clearance. Memwah recommends that you check with your local customs officials or post office for more information regarding importation taxes/duties that may be applicable to your online order. You will be the importer of the goods and responsible for any import VAT and duty that may be borne. In addition, any charges for import clearance will be borne by you, the customer.

General

Please note that when shipping goods from Jersey, cross border shipments may be subject to opening and inspection by customs authorities. In respect of all goods dispatched to you to an address outside of Jersey, you are deemed to be the importer of the goods and must therefore comply with all the laws and regulations of the country into which the goods are being delivered.

Governing jurisdiction

This contract is made between you, the User, and Memwah under laws of Jersey and is subject to the exclusive jurisdiction of the Jersey court.

Liability

This section applies only to the extent permitted by law. For the avoidance of doubt, Memwah do not exclude or limit any liability for (a) personal injury (including sickness and death) where such injury results from Memwah's negligence or wilful default, or that of Memwah's employees, agents or subcontractors or (b) fraudulent misrepresentation.

Memwah does not accept liability (except as set out below) for any errors and omissions and reserve the right to change information, prices, specifications and descriptions of listed goods, products and services.

If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. In the event that you order an item and the price published on the Site is incorrect for any reason, we will contact you to let you know the correct price and ask you whether you still wish us to fulfil your order at this price. We shall be under no obligation to fulfil an order for a product which was advertised at an incorrect price. We shall give you the option of confirming the order at the correct price or if you so choose, to cancel the order altogether. If you cancel and have already paid for the goods in the circumstances described in this clause, we shall purchase the items from you at the full amount in accordance with these Terms.

Memwah will do its best to correct errors and omissions as quickly as practicable after being notified of them.

TO THE FULLEST EXTENT PERMITTED BY LAW, Memwah.com IS PROVIDING THIS SITE AND ITS CONTENTS ON AN _AS IS_ BASIS AND MAKES NO (AND EXPRESSLY DISCLAIMS ALL) REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THIS SITE OR THE INFORMATION, CONTENT, MATERIALS OR PRODUCTS INCLUDED IN THIS SITE INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN ADDITION, Memwah DOES NOT REPRESENT OR WARRANT THAT THE INFORMATION ACCESSIBLE VIA THIS SITE IS ACCURATE, COMPLETE OR CURRENT.

In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, Memwah shall, at its own option, make good any shortage or non-delivery, replace or repair any damaged or defective goods, or purchase the items from you to the amount you paid for the goods in question PROVIDED THAT you notify Memwah of the problem in writing at the address stated in the confirmation e-mail within 10 working days of delivery of the goods. NOTHING IN THIS CLAUSE AFFECTS YOUR STATUTORY RIGHTS.

You and Memwah will only be liable under these Terms for losses which are a reasonably foreseeable consequence of the relevant breach of contract.

The products sold on the Site are provided for private domestic and consumer use only. Accordingly, Memwah do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the Site or for any products or services purchased from Memwah.

All electrical products are covered by a twelve month manufacturer's warranty. If your product develops a fault while under warranty, please contact Memwah and we will advise you where to send it for repair. It is a "return to base" warranty therefore there will be a delivery charge to return the product back to the relevant service centre.

Memwah does everything in its power to respect the delivery times indicated on the website. Orders with multiple purchases may not be shipped in one parcel. You will not incur any additional charges in these situations. We cannot, however, be held responsible for the consequences of a late delivery or the loss of a package caused by a third-party contracted to make delivery, or by you, or because of some unforeseen event or an Act of God.
